Terms and conditions for davidpandone.com and the items of value or available service associated therewith:
General Terms:
Trade on davidpandone.com is a “private” rather than “public” matter. This site bears my “good name” which stands with you as I would while I cannot be available to trade with you man to man due to schedule availability or convenience of common venue.
While government service corporations assume the “jurisdiction” over “commerce” among corporate entities for the “public welfare”, you and I as men, or man and woman, are associating willingly in trade among members in temporary agreement offered for consideration of “one penny or $0.01” as portion of each trade offer (included in all trade offers*) and expressed here as “terms and conditions” stated herein and by extension in our “refund and return” policy.
*[trade offers are commonly mislabeled “prices”]
Your view or access to anything offered for trade on this site including books, files (downloads), courses, or memberships, assumes your intent and acceptance of this temporary agreement from the time you access and review any such value offered in trade on site, while you process such trade on the cart page, and is terminated when you submit value for your trade (pay) and conclude your trade.

I know all that sounds unusual, but it only sounds unusual because government service corporations and their “agents” have conditioned “US Citizens” over many decades to believe it’s normal for them to have their hands in our pockets at every turn. It is not. It’s perfectly normal and the right of two people to trade their respective value in property without needing to “ask or pay government” as if it were a privilege. It’s time that “we the people” comprehend and embrace such ideas again; one of the themes of this site.

Unless your corporate business is ordering from another corporate business, it is assumed that exchange of value here on davidpandone.com from one man or woman to another man or woman is a form of “trade in private”. Completing such trade here on davidpandone.com assumes your agreement to such terms as “trade among men and women in private”.
Payment Method:
Consideration currently accepted in the form of Federal Reserve Notes: It is preferred that trade be conducted in official U.S. Dollars as described in the Coinage Act of 1792, or as an option, as specified in Federal Law as 12 USC §411 U.S. Dollars as “lawful money”. HOWEVER, the payment processing services through coercion of the Federal Reserve and member banking institutions currently offer no other option and only process payments in Federal Reserve Notes; a form of currency known as a “bill of credit”. (I encourage you to read up on this topic by keyword search of my blog).
Taxes:
Sales taxes are affixed by each state, and more specifically, by “State of state” government service corporations. Since all state governments have assumed a defacto (illegitimate) organization as a “government service corporation” rather than lawful government, taxes will not be collected on what is considered “trade” among men and women in temporary agreement of association here on the davidpandone.com website.
Trade among men and women in private proceeds outside the jurisdiction of “commerce among states” and is therefore not taxable, in direct contrast to “commerce” and “traffic” of “goods” among corporate entities as overseen “for the public welfare”. To simplify tax calculation and operations on this site, corporations and corporate agents are responsible for calculating and paying their own state and local sales taxes.
(Haven’t the lawyers and politicians made our land such a fun place to live? Be careful not to step in something they’ve left behind!)
Books in Print:
MoneySmart books in print are listed on davidpandone.com mainly offered for trade in quantity at a discount, and/or other items which are not available from our primary commercial fulfilment channel at Amazon.com. Other titles include “signed by author” and “open box” discounted books which are also not available through the primary fulfilment channel.
Secrets of Subdivision books in print are not currently available through another distribution channel. Single copies are available for those who desire to trade for their own copy. Multiple units, discounted for trade, intended for educators and resellers to resell in the retail space are also available.
Shipping:
The most cost effective means to ship books at this time is “media rate” through the US Postal Service, which also happens to be the slowest method. Rates for three to ten book boxes vary and are subject to change without prior notice. Other means of shipping will be made available as the most convenient and economical options are found for various shipping destinations. I am not wholly satisfied with the pricing on any of the shipping methods at present due to the rising costs of fuel and effects of inflation.
Special Orders:
Submit inquiries for orders , quantities, or items not listed in the product lineup via email from the “Contact Us” page. A phone is listed but there is no “office staff” to take your call. Leave a message and I’ll return calls as quickly as I can and as time allows.
No Guarantee or Warranty:
Use of the strategies in the MoneySmart book, downloadable guides, online content, articles, and other media is presented “as is” without warranty or guarantee as to its effectiveness to the end user. There is simply no reasonable means by which “education” or “comprehension” can be warrantied.
I know the MoneySmart methods and strategies work when applied correctly to the appropriate issues, but each end user has a set of financial circumstances unique to themselves. The end user’s understanding of the concepts and strategies cannot be accurately tracked nor guaranteed, therefore, the application of whatever level of understanding to their own unique situation cannot be guaranteed.
These items have been developed with the intention to help the end user reach a higher degree of financial literacy, thereby allowing them to undertake their own analysis, strategy creation, and decision process; a process and decision for which they alone are responsible.
Returns:
Pay close attention to product descriptions for items that are specifically not eligible to be returned for credit or compensation. Chief among these are the digital downloads, intellectual property, education, and information products available through the online courses. Downloadable items such as electronic files, articles, or worksheets are also among such items of value offered in trade for currency, money, or credit.
Once exposed to information or education classified as “intellectual property” and “education” once it has been made available to the end user is an intangible form of value that cannot be “unlearned, unexposed, unread, or unassociated” with the content, context, and cognizance of the end user. Whether the content has been accessed, copied, read, or otherwise interacted with by the end user, no means exists to monitor or track what the end user has seen, read, understood, or conceptualized once trade is completed and access to such information is made available or unlocked. “I didn’t access it, download it, open it, watch it, or read it” is not an acceptable argument in such case since there is no way to prove such an assertion nor return any benefit gained thereby.
Once the end user has surrendered value in currency, credit, or money in exchange for intellectual property value, these trades are final and are marked as such in the associated product descriptions.
Digital Media and Downloads:
Downloadable content is developed and tested on the Apache OpenOffice suite of programs and works as intended in the forms posted at the time the file was posted. Once in possession of the end user, the digital files are capable of being edited by the end user and therefore rendering the programming be changed from its original design. These items are offered without warranty or guarantee. These files are intended to be a handy starting point, a means to save the end user a great deal of work in solving the issues for which they are intended.
These digital files are not guaranteed to work across all platforms as many platforms exist which can open such files and the files are NOT tested exhaustively across all of them. In particular, spreadsheet files that are made available as .xls or .ods files are widely supported in many platforms but some functions may require the end user update the macros, graphics, and more specific details so that they function to expectation. These such items have been strategically discounted with other items, such as with related courses, to further ensure their usefulness through related education, decrease the cost of trade, and increase the value to the end user.
