A public facing business and publishing activity whose physical and intellectual properties are envisioned, created, and owned in total as private property until traded for consideration “by: david alan pandone” acting in trade as “David Alan Pandone”.   The business activities, intellectual property creation, and service in trade include books in print, live lectures, educational and informational videos, online educational courses, articles (see the blog), commentary, research, opinion, and other information related directly or indirectly to areas of interest and my own experience through which I hope to aid and edify those who seek access to such aid. Service descriptions and a library of client reference information for David Pandone Wealth Strategies business activity is also cataloged on this site.

What personal data we collect and why we collect it

It is worthy of mention that in response to the amount of government regulation of financial services here in the United States that discussing financial information, even when that information is specifically qualified as “opinion” and not “financial advice”, it becomes prudent to ensure the age and the home state of that whom we are addressing be known. State and Federal regulatory agencies are rather sticky about the scope of one’s licensure or certifications and commentary that financial professionals provide if and when it would be qualified as “advice”, to whom, and in what jurisdiction.  

To those ends, with the intent to avoid any violation of law and regulation, we have established the dpRE PMA format for research and education activity which will now occur “in private” rather than in “public”.  The “state”, or governing power, assumes jurisdiction to oversee such “for the public welfare”.  We thereby withdraw our offer of “service to the public” and rather communicate and trade such “in private”.  In the interest of tailoring our commentary and discussion content for each individual comment or question is why your date of birth and home country are required information here on davidpandone.com.  In addition a valid email address to maintain open communication and a lawful first name is also required.

Your profile is established so that you may access member-only content and may at any time of your choosing contribute to discussions, comment on pages, articles, blog posts, and other content with a profile that connects to your on-site activities. It is our intention to encourage responsible and respectful discussion and we find and have ample evidence that complete anonymity is antithetical to such civil behavior in today’s online world. I find that when people’s actions are divorced from their true identity that they have the tendency to behave in a less-than-civil manner. Therefore, identity will be registered through a “username” until which time it becomes obvious that a first and last name is necessary to discourage poor manners. The site bears it’s founders name who regards the site as a virtual home for his thoughts and opinion on these topics and will respect all guests who display good manners, intelligent discussion, thoughtful debate, and respect for others. Those intentionally pursuing discord or disruption will be shown the door with abundant velocity added.

The Google reCAPTCHA system has been employed to further discourage bots and other non-human or non-civil actors from interjecting distracting or disturbing content into chat and commentary sections.

At this time your registration and profile on davidpandone.com allows you to opt-out of certain information that would reliably locate you as a unique personality in the world. The information we collect here on the site is limited to both protect you the user, and limit our liability in making if difficult, for any and all those seeking to exploit such, to produce actionable information on any member with such limited information. While fields do currently exist or may be added in the future where you may (at your option) provide more contact information that would more specifically identify you, we intend those fields to be optional. We don’t require nor do we encourage for our purposes of education and topics of discussion the extensive listing of personal information on the site. The less you disclose, the more secure we shall all be; the internet is still the wild, wild west. davidpandone.com is more focused on information going ‘out’ as educational or for purposes of discussion from this location than the pursuit of data headed into it; however anti-opportunist that standing might be.

I do seek through the site the opportunity to attract and serve a larger client base and will maintain contact information through email services as outlined below. If you provide a means of contact, either email or phone number, davidpandone.com, MyMoneySmart, LLC, David Pandone Wealth Strategies, and David Alan Pandone each reserve the right to contact you for business purposes through those means. Once contact is established through email or by phone and a “client” relationship is established, your profile maintained on the website as “subscriber” if any, and client data maintained for client services will be maintained as wholly separate entities.

Personal data is also generated from technical processes such as contact forms, comments, cookies, analytics, and third party embeds. By default WordPress does not collect any personal data about visitors, and only collects the data shown on the User Profile screen from registered users. However some plugins may collect personal data and this information is listed below.

Submissions

Any comments, stories submitted, testimonials, or any communication shared publicly here on davidpandone.com becomes a functioning part of the community and therefore the property of David Alan Pandone, davidpandone.com, and MyMoneySmart, LLC by proxy. Do not expect if you delete your profile from the site that efforts will be made to “scrub” your presence from the site and any of your historical activity. If you post it, you do so willingly and you surrender your rights to control that which you have posted. No one will make time to clean up after you.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using Gravatar. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture or icon is visible to the public in the context of your comment.

Media

All uploaded files to the website for display are publicly accessible. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can likely access images, download, and extract any location data from images posted publicly to the website.

Contact forms

This site employs email marketing through GoDaddy.com whose opt-in opt-out features are user controlled and can be accessed at the bottom of each email generated.

Who we share your data with

davidpandone.com currently has no intention of monetizing your contact information in any way or providing your email or identity information to any third party or associated business partners outside the trade activity you actively approve in purchasing memberships or trade here on site. Google ads may run on the site and therefore you may see ad placements update with ads that Google has targeted to align with your interests and recent activities on the internet based upon Google’s proprietary tracking activities.  You can control these functions through your Google account settings.

In addition, since adding MemberPress and WooCommerce functionality to the site, we have also needed to add payment functionality for memberships, course fees, items purchased in trade.  Payments are handled by Stripe with Google Pay and Apple Pay activated as options.  Stripe was chosen over other alternatives specifically because no payment information is processed nor maintained here on davidpandone.com, but is handled on Stripe’s online resources by Stripe.  This limits the exposure of user data and thereby the risk to exposing user data to malicious actors on the internet.  It is our intent that if such information is neither collected nor stored on davidpandone.com, it becomes impossible to acquire through davidpandone.com; added security for all concerned.

MemberPress features to manage subscriptions and memberships thereof was added in 2021.  WooCommerce, an extension of MemberPress, was added in January of 2022.  Both of these features make use of online payment routines through Stripe as discussed above.  User information may be gathered at the user-purchaser’s approval to conduct trade for memberships, subscriptions, courses, digital, and physical items in trade.  To reiterate, Stripe collects and manages this user payment information at Stripe’s resources and payment information is neither intended to be maintained by David Alan Pandone, or on the resources of davidpandone.com.

If the privacy policy here at davidpandone.com should change to include attempts for monetization or sharing to third party associates of profile information at any time in the future, notice will be posted so that users have opportunity to adjust any information in their site profile as the user would feel appropriate.

As mentioned above, any personal contact data submitted to this site is used for communication, education, and trade purposes of David Alan Pandone, davidpandone.com, MyMoneySmart, LLC, and/or David Pandone Wealth Strategies activities and is not intentionally shared with third-party marketing organizations nor affiliates for the purpose of deliberately monetizing your personal data. By default WordPress does not share any personal data with anyone.

How long we retain your submitted data

When you register with davidpandone.com as a “subscriber” you do so willingly and your profile data is maintained until you as the user deletes your account. Required information as discussed above is deleted with the account and user profile. Any comments, responses, questions, communications, emails or other contact types yet to be determined outside of your own profile information become the property of davidpandone.com and MyMoneySmart, LLC by proxy.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

The only identifying information required for “subscriber” membership and full site access is a user name, a first name, a functional email address, the year of your birth, the state in which you reside if a US resident, and your country. As explained in the opening paragraphs of this rather painful and lengthy legal snipe hunt, this information allows us to tailor our “opinion” on topics discussed in comments to those inquiring according to their state, their country of residence, and their approximate age, which financial regulatory authorities tend to regard as “an important consideration”.

If you have an account on this site, maintaining, adding to the information, or deleting your profile and the information contained therein is under control of the end user who is free to delete their profile, subscriber status, and member-only access at any time.

This does not include any data we are obliged to keep for administrative, legal, or security purposes.
